Home > Guides > Faxing a lease agreement
Yes, you can fax a lease agreement, and a faxed signature on a lease is generally treated as valid in both the US and Canada. The catch is practical, not legal: a faxed copy can be hard to read, pages can go missing, and some landlords, property managers, or housing authorities still insist on an original. Send the fax, then confirm receipt and keep your own signed copy.
This is general information, not legal advice.
In most US states and Canadian provinces, a signature sent by fax counts the same as a signature on paper, because the law cares that both sides agreed and signed, not how the ink travelled. Electronic-signature laws in both countries back this up for most everyday contracts, and leases are no exception. Courts have accepted faxed signatures for decades, since fax was the standard way to close a deal at a distance long before email.
That said, validity and proof are different things. If a dispute ever reaches a hearing, the side with the cleaner paper trail wins the argument faster. A fax confirmation page proves a transmission happened, but it does not prove what was on the pages. Keep your signed original, the confirmation page, and any email or message where the other side acknowledged receipt.
| Situation | What usually happens with a faxed lease |
|---|---|
| Landlord and tenant both sign, fax copies exchanged | Treated as a binding lease in most cases |
| Only one side signs | Not a complete agreement until the other side signs too |
| Lease requires an original in writing | The lease's own clause can override the general rule, so read it first |
| Rent-controlled or subsidized housing filing | The housing authority may demand an original or certified copy |
Sign every page that asks for initials, not just the last page. Leases are long, and a fax that drops a middle page can leave a clause unsigned, which is exactly the kind of gap that causes fights later. Number the pages on the cover sheet ("page 1 of 14") so the recipient can spot a missing page at once.
Use dark ink and print rather than cursive for initials, since fax resolution blurs light handwriting. Send during business hours when someone is near the machine, and call right after to confirm the full document arrived legibly. Ask the other side to fax or email back a countersigned copy, so both of you hold the same version with both signatures on it.
Some leases contain a clause saying the agreement is only effective on exchange of originals. If yours has one, a fax alone does not close the deal, and you should follow it up with the mailed original. Government and subsidized-housing programs are another common exception: the file they keep may have to be an original, and a fax will be rejected at the counter.
Notarization is a third case. A lease that must be notarized, which is rare for residential leases but common for some commercial ones, cannot be completed by fax alone in most places, because the notary has to witness the signing in person or through an approved remote process. Check the lease and the local rules before you assume a fax finishes the job.
Renewals follow the same logic as the original lease: a faxed renewal signature is generally fine unless the renewal clause says otherwise. Watch for one trap, though. If the original lease required written notice of renewal by a certain date, the fax confirmation page becomes your proof of timing, so save it with the date visible. The same applies to amendments like a pet addendum or a parking change: fax the signed amendment, get a countersigned copy back, and staple it to the lease so the full agreement stays in one place.
