Usually not by law, but usually yes in practice: business and especially healthcare recipients expect one. A cover sheet states who the fax is from and to, how many pages there are, and carries a confidentiality notice so a fax that lands on the wrong machine warns the reader not to keep it. If you skip it, at minimum confirm the fax number before sending anything sensitive.
Three jobs. First, routing: a fax machine is often shared, sitting in a hallway or a front office, and the cover sheet's "To" line is what gets your pages into the right hands instead of onto a pile. Second, completeness: the page count ("Page 1 of 4") tells the recipient whether anything went missing in transmission, which is the fax-era equivalent of checking the attachment actually attached. Third, confidentiality: the notice at the bottom warns anyone who receives the fax by mistake that the contents are private and should be destroyed, not read or passed along.
That third job is the one with real consequences. A misdialed fax is one of the classic ways private information leaks: one wrong digit and your medical records, financial documents, or legal papers print out on a stranger's machine. The confidentiality notice does not un-send the fax, but it is the standard of care in healthcare and legal settings, and it is what organizations' policies require their staff to include.
Keep it to one page. A cover sheet that runs long defeats its own purpose:

No general law mandates cover sheets on faxes. But several situations make one effectively mandatory. Healthcare is the big one: faxing patient information without a confidentiality notice violates most organizations' privacy policies and, in the US, runs against HIPAA's expectations for safeguarding protected health information. Many clinics and hospitals will not process a fax that arrives without one. Legal offices have similar internal rules, and plenty of companies require cover sheets by policy for anything sensitive.
There is also a practical angle people overlook: the minimum-necessary habit. A cover sheet forces you to write down the recipient's fax number and double-check it before sending, which is exactly the moment when misdials get caught. If you fax sensitive material regularly, make the cover sheet a checklist item in your routine, not an afterthought.
For a two-page fax to a small office where you know the recipient personally, nothing bad will happen. The cover sheet is a courtesy there, not a requirement. But skipping it on a long fax to a large organization is asking for the pages to be separated, misrouted, or partially lost: without a "To" line and a page count, nobody receiving a stack of pages can tell they are incomplete or who they belong to.
The one non-negotiable, cover sheet or not: confirm the fax number. Call the recipient or check it against a trusted source before sending anything you would not want a stranger to read. A cover sheet with a confidentiality notice is your safety net; the correct number is your actual protection.
