What is the confidentiality notice on faxes?

It's the short legal paragraph printed at the top or bottom of a fax: it states the fax is confidential, names the intended recipient, and tells anyone who got it by mistake to notify the sender and destroy the copy. Healthcare and legal offices use it because they fax sensitive records constantly. It reduces risk; it does not stop a misdirected fax from being a privacy breach.

What does the notice actually say?

Most notices run three or four sentences: this fax contains confidential information intended only for the named recipient; if you received it in error, please notify the sender at the number shown; do not copy or distribute it; destroy or delete the misdirected copy. Healthcare offices and law firms print it on their cover sheets, and many pre-program it into the fax machine itself so it appears on every outgoing page without anyone having to remember. The exact wording is a policy choice, not a legal formula: no law dictates the text, and a widely believed claim that health privacy law requires specific disclaimer language is simply wrong.

What belongs in a confidentiality notice?

ElementExample wording
Sender identification"This fax is from [name], [organization], [phone number]."
Confidentiality claim"This fax contains confidential information intended solely for the named recipient."
Misdelivery instruction"If you received this in error, please call [number] immediately."
Destruction instruction"Please destroy all copies and do not disclose the contents."

What can't the notice do for you?

A notice does not stop a misdial from being a privacy breach. If patient records or client files land on a stranger's machine, the paragraph at the bottom doesn't undo that: depending on the jurisdiction and the data involved, the sender may still have to report the breach to a privacy commissioner or regulator. It also can't stop the recipient from reading the pages. By the time someone reads the notice, they have already seen the content. Think of it as a seatbelt rather than a force field. Its real value is evidentiary: it shows the organization took reasonable steps to protect the information, which is what privacy regulators actually look for after an incident.

What should you do when you get someone else's fax?

Don't copy it, forward it, or file it. Call the sender at the number on the notice, tell them the fax arrived at the wrong number, then delete or shred it. A healthcare or legal office may ask you to confirm the destruction in writing, and that request is reasonable. If misdirected faxes from the same sender keep arriving, ask them to remove your number from their speed-dial list. Stale speed-dial entries, numbers saved years ago and never verified, are one of the most common causes of repeat misdials. A quick verification call before the first fax to a new number prevents most of these incidents entirely.
