How do I mail a lemon law demand letter?

Send a written notice to the manufacturer (not just the dealer) by certified mail with return receipt requested, before the warranty ends. List the defects, repair attempts with dates, and state that you will pursue a refund or replacement under your state's lemon law. Keep a copy of everything.

Why does the notice have to go to the manufacturer?

Every state lemon law works the same way on this point: the written notice must reach the manufacturer or an authorized dealer, because the manufacturer is the party legally responsible for refunding or replacing the vehicle. Writing only to your dealer can fail to start the clock in some states. Minnesota's Attorney General advises consumers to send the letter to the manufacturer directly, and if you send it to the dealer instead, to send a copy to the manufacturer and keep a copy for your own records. Under Minnesota's statute, if the dealer receives your notice it must forward it to the manufacturer by certified mail, but you shouldn't rely on the dealer to do that for you.

What the letter must include (per the Minnesota AG's guidance)Example
Your name, address, and phone numberSo the manufacturer can respond
Date you purchased or began leasing the vehicle"Purchased March 3, 2026"
A list of the defects and systems affected"Transmission shudder at 40 mph; coolant leak from radiator"
How many times the vehicle was repaired for the same problem, with dates"Three repair attempts: June 2, July 14, August 29"
A statement that the defect still exists as of the letter's dateRequired to show the repair attempts failed
A reference to the lemon law and a statement you will pursue a claimCite your state's statute by number
A request for information about the manufacturer's arbitration programMost states require the manufacturer to offer one

When does the timing matter most?

The notice generally must go out before the warranty coverage period ends, and your repair-attempt log is the backbone of the whole claim. Keep every repair order and receipt from day one, and make sure any visit lasting more than a day shows both the drop-off date and the date you were told the car was ready, since time out of service is a separate qualification path in many states. In Minnesota, the common benchmarks are four repair attempts for the same problem or 30 business days in the shop, but a claim can still succeed outside those benchmarks if you first reported the problem during the warranty period. Lemon law claims are for serious defects: faults that substantially impair the vehicle's use or market value, or life-threatening failures of the braking or steering systems.

What happens after I mail it?

The manufacturer gets one last opportunity to fix the defect, which is the entire legal purpose of the notice. If the vehicle still isn't right, your next steps depend on the state: many states run a manufacturer arbitration program you must use before suing, and court action carries its own filing deadlines. In Minnesota, for instance, you generally have three years from original delivery to bring an action, and six months after an arbitration decision if you appeal it. Keep the return receipt card the post office sends back: it proves the manufacturer received the notice and on what date, which can be decisive if the timeline is disputed.

How do I know my state's lemon law is different from this?

It will be, in the details. Repair-attempt counts, coverage windows (two years or a mileage cap), who must be notified, and whether arbitration comes before a lawsuit all vary by state. Every state attorney general publishes lemon law guidance: read your state's page before drafting the letter, and quote your own state's statute number instead of borrowing another state's. The certified-mail requirement and the repair-log discipline are universal enough to carry over everywhere.
