Can my landlord withhold my mail over unpaid rent?

No. A landlord may not hold your mail, hide it, or threaten to withhold it to force you to pay rent. Mail is a federal service, not landlord property, and using it as a pressure tactic over rent can be a crime. Rent disputes go through notices and eviction courts, never through your mailbox. Document what happened and report it.

This is general information, not legal advice.

What the landlord doesHow the law treats it
Opens your mailA separate offense: opening mail addressed to someone else is a federal crime
Holds your mail to pressure you into payingInterference with mail delivery, also unlawful
Threatens to hold mail "until you pay"The threat itself is evidence of improper interference; document it
Refuses to give you a key to the building mailboxGenerally unlawful: tenants have a right of access to their own mail

Is withholding mail the same as opening it?

They are related but distinct. Opening someone else's mail is punished as a mail-opening or mail-theft offense, while holding mail you never opened is punished as interference with or obstruction of mail delivery. Both are federal-level offenses, and a landlord can commit both at once. The distinction matters mainly for how you describe the complaint: "my landlord opened my mail" and "my landlord is holding my mail hostage over rent" point investigators at different behavior.

What can the landlord legally do about unpaid rent?

Every state and province has a lawful process, and it always runs through written notice and the courts. Typically the landlord serves a notice to pay or vacate, and if the tenant does not comply, files an eviction action. The landlord may also pursue the debt through small claims court or a collection agency. What the landlord may never do as self-help: change the locks, shut off utilities, remove your belongings, or interfere with your mail. Any of those can expose the landlord to penalties and civil liability on top of losing the eviction case.

What if the landlord says they "forgot" to pass along my mail?

In buildings with a single shared mailbox or a landlord who collects mail for everyone, delays sometimes happen innocently. The test is the pattern. Occasional forgetfulness is not a crime; systematically holding mail, holding only your mail, or holding mail exactly during a rent dispute is. If you suspect your mail is being held, start by writing the landlord a dated message asking that all mail be delivered promptly, and keep a copy. If mail then goes missing, file a complaint with the US Postal Inspection Service (in Canada, your local police and Canada Post), and keep a log of every missing piece.

Should I keep paying rent while this is happening?

Yes. Withholding rent over the mail dispute creates a separate problem that weakens your position. Pay the rent you owe, document the mail interference separately, and report it. A tenant who is current on rent and has a documented mail complaint is in a far stronger position than a tenant with two disputes running at once. If you have a genuine counterclaim, a tenant legal aid clinic can advise on the right way to raise it.
