Can my landlord open my mail?

No. Opening mail addressed to someone else is a federal crime in both the US and Canada, and being your landlord is not a defense. Even if you owe rent or the envelope arrived at the building's address, only the addressee may open it. Keep the envelope and report it to the US Postal Inspection Service, or in Canada to the local police and Canada Post.

This is general information, not legal advice.

What law makes opening someone else's mail a crime?

In the US, federal mail-theft statutes make it a crime to take, open, or destroy mail that is not addressed to you, whether you are a landlord, a roommate, or a stranger. The law protects the mail itself, not the address on the building. In Canada, the Canada Post Corporation Act makes it an offense to open, keep, or delay mail that is not addressed to you, with penalties set by federal law. In both countries the offense is federal, which means a landlord cannot override it with a lease clause or a building policy.

Does it matter if I owe the landlord money?

Not at all. An unpaid rent balance gives the landlord lawful collection remedies, like a notice to pay or an eviction filing in court. It does not give them any right to your mail. A landlord who opens your mail "to see if there is a check inside" or "because you owe me" is committing a crime regardless of the motive. Debt collection disputes never create an exception to mail privacy.

What should I do if my landlord opens my mail?

First, keep the envelope exactly as you received it, since a torn or resealed envelope is evidence. Write down the date, what the letter was, and anything the landlord said about it. Then report it: in the US, file a complaint with the US Postal Inspection Service, which investigates mail crimes, and consider a report to your local police as well. In Canada, report to your local police and contact Canada Post. A tenant legal aid clinic or housing attorney can advise on whether you also have a civil claim. Patterns matter more than single incidents, so documenting every occurrence builds the case.

What if the landlord says it was an accident?

Occasional accidents genuinely happen, especially in buildings where mail is sorted by hand. The distinction is the pattern. One misdelivered envelope opened by mistake is very different from repeated "mistakes" that keep targeting your mail. If it happens more than once, write to the landlord stating that you have noticed it and expect it to stop, and keep a copy. That letter puts them on notice and creates a paper trail if the behavior continues.
