Yes. The IRS accepts Form 2553 by fax or mail only; there is no e-file option for a standalone S corporation election. Fax it to the IRS service center covering your state, keep the signed original with the corporation's permanent records, and keep the fax confirmation as proof of timely filing. The numbers below were confirmed on the live IRS instructions, which note they can change.
This is general information, not tax advice.
| Where your corporation's principal office is | Fax it to |
|---|---|
| CT, DE, DC, GA, IL, IN, KY, ME, MD, MA, MI, NH, NJ, NY, NC, OH, PA, RI, SC, TN, VT, VA, WV, WI | IRS Kansas City service center, fax 855-887-7734 |
| AL, AK, AZ, AR, CA, CO, FL, HI, ID, IA, KS, LA, MN, MS, MO, MT, NE, NV, NM, ND, OK, OR, SD, TX, UT, WA, WY | IRS Ogden service center, fax 855-214-7520 |
Form 2553 is timely if it is filed no more than 2 months and 15 days after the beginning of the tax year the election is to take effect, or at any time during the tax year before the election year. For a calendar-year corporation electing S status for the current year, that usually lands around mid-March. Because fax transmission is effectively instant, faxing is the safer choice when you are up against the deadline: the confirmation page shows the exact date and time the IRS received it, which is exactly what "timely filed" hinges on.
The IRS instructions say to keep the original signed election with the corporation's permanent records when you file by fax. That matters because an unsigned Form 2553 is not considered timely filed, and the IRS will want the original if there is ever a question. Keep these three things together:
The IRS generally notifies the corporation whether the election is accepted within about 60 days. If you hear nothing after about two months, the instructions say to follow up rather than assume it went through.
LetterAgent sends faxes to US fax numbers, which covers both IRS service center numbers above, and the page count is quoted up front before you approve the send. Two caveats: fax is currently in testing with limited availability, so it is not something to rely on for a same-day deadline yet, and you still need to keep the signed original yourself. For a deadline-sensitive election, the practical order is: sign the form, scan it, send the fax early enough that a retry is possible, and file the original and confirmation together.
