Can I fax a QDRO to a plan administrator?

Yes. Plan administrators routinely accept draft QDROs by fax for pre-approval review, and many plans specifically ask for it. But the final, court-signed certified copy usually has to arrive as a physical original. Fax the draft early, get the plan's written qualification approval, then have the judge sign the approved language.

This is general information, not legal advice.

Why does the draft/final distinction matter so much?

A QDRO (Qualified Domestic Relations Order) is the court order that splits a retirement account in a divorce. The federal law behind it, ERISA, says the plan administrator must decide whether the order is "qualified" before it pays anyone. That review takes time, and the plan can sit on the money for up to eighteen months while it sorts things out. That is why faxing the draft is so common: it starts the clock early.

The mistake people make is faxing the signed final order and assuming the job is done. Most plans will not qualify a faxed copy of the final order. They want the certified court copy with the raised seal, which does not travel by fax.

StageFax it?What the plan does

Proposed order going to the judgeOptional, confirm with the planSome plans want one last look before the judge signs
Final court-signed certified copyNo, mail the originalQualifies the order and processes the division of the account

How do I find the right fax number?

Do not use a general customer-service fax line. Large plan administrators keep a dedicated QDRO department or use an outside QDRO processor with its own fax number, which is usually printed in the plan's QDRO procedures or in the benefits booklet. Call the plan and ask for the QDRO group by name. Send a test page first if the order is long; nothing ruins a review like a fax that arrived with half the pages missing.

What should the fax cover sheet include?

Put the participant's full name, the last four digits of their Social Security number, the plan name, and the word "QDRO" in large letters at the top. Add your name, your law firm's name, and a callback number. Number the pages ("page 1 of 12") so the reviewer can spot a gap. If you are following up on an earlier submission, reference the date of the original fax and the name of the person you spoke with.

What does the plan's pre-approval actually give me?

A written letter saying the draft qualifies under the plan's procedures. That letter is gold: it means the judge can sign the order knowing the plan will accept it, and it avoids the expensive loop of getting an order signed, rejected by the plan, and redrafted. Keep that approval letter with the divorce file forever. Years later, when the alternate payee goes to collect, that paper trail resolves arguments fast.

Does Canada have an equivalent?

Canada has no exact QDRO, but the mechanics are similar. In Ontario, pension division goes through the Family Law Act with forms filed through FSRA (the Financial Services Regulatory Authority of Ontario), and administrators charge a fee to calculate the family-law value. Whether a given Canadian administrator accepts faxes for pre-approval is plan-by-plan, so ask in writing and keep the answer.
